Trademark could be symbol, word, design, or phrase that helps one to distinguish one manufacturer of goods from another. key identifier of a company used all over the world or in a specific country. The most famous example is Apple, which is represented by bitten apple. This mark does not have any text but the image itself is key identifier of Apple.
Another Strong Example: McDonalds` mark is a golden ‘M’ which is globally recognized by people of all the ages since long time, that is, 1955.
Additionally, in lots of circumstances, trade/service marks can also involve colors, music and smell. For example, Coke is well known mark identified by its red and white color combination.

What are the steps for registering a trademark?

Registering a trademark is a very lengthy process and requires a lot of detailed filling, depending on countries where the trademark(s) is/are applied for registration, we at Million Makers have divided the process into 3 major steps:

Step 1 – Trademark Study

During any Trademark study, we conduct a thorough search to ensure that an identical trademark (or any kind of similar trademark) is not currently registered. An analysis is conducted to ensure that registration submitted is distinctive enough to obtain the trademark.  There is always a very comprehensive study conducted by an experienced Intellectual Property attorney who prepares a thorough report on the chances of successful registration along with his / her recommendations.

Step 2 – Trademark Registration Request

The Trademark Registration Request includes preparation and filing of trademark application by an Intellectual Property attorney with expertise. An examiner from the Trademark Office reviews application and recommends application to proceed to publication phase, or the examiner can also object to information contained in the application. Incase, our examiner objects to the application, you will be notified immediately and informed about further action, in order to proceed, once trademark proceeds to the next phase, public notice of the trademark is published for a period of approximately three months to give others an ample opportunity to formally oppose to the registration process. Once the publication period passes and all oppositions have been resolved, the trademark registration is accepted.

Step 3 – Registration Certificate

This step varies from country to country. Not all countries charge for the certificate once the application has been accepted yet most of the countries charge an official fee for the issuance of the certificate. Once the fee is paid, the government`s issued Trademark Registration Certificate is forwarded to you and the trademark is listed in official records as Registered, hence, giving legal rights to the owner of the trademark to use ® symbol besides the trademark.

International applications governed exclusively by the Agreement.

The following fees shall be payable and shall cover 10 years:

  • Basic fee (Article 8(2)(a) of the Agreement)
    • where no reproduction of the mark is in color
    • where any reproduction of the mark is in color
  • Supplementary fee for each class of goods and services beyond three classes (Article 8(2)(b) of the Agreement)
  • Complementary fee for the designation of each designated Contracting State (Article 8(2)(c) of the Agreement)

International applications governed exclusively by the Protocol

The following fees shall be payable and shall cover 10 years:

  • Basic fee (Article 8(2)(i) of the Protocol)
    • where no reproduction of the mark is in color
    • where any reproduction of the mark is in color
  • Supplementary fee for each class of goods and services beyond three classes (Article 8(2)(ii) of the Protocol), except if only Contracting Parties in respect of which individual fees (see 2.4, below) are payable are designated (see Article 8(7)(a)(i) of the Protocol)
  • Complementary fee for the designation of each designated Contracting Party (Article 8(2)(iii) of the Protocol), except if the designated Contracting Party is a Contracting Party in respect of which an individual fee is payable (see 2.4 below) (see Article 8(7)(a)(ii) of the Protocol)
  • Individual fee for the designation of each designated Contracting Party in respect of which an individual fee (rather than a complementary fee) is payable (see Article 8(7)(a) of the Protocol) except where the designated Contracting Party is a State bound (also) by the Agreement and the Office of origin is the Office of a State bound (also) by the Agreement (in respect of such a Contracting Party, a complementary fee is payable): the amount of the individual fee is fixed by each Contracting Party concerned

International applications governed by both the Agreement and the Protocol

The following fees shall be payable and shall cover 10 years

  • Basic fee
    • where no reproduction of the mark is in color
    • where any reproduction of the mark is in color
  • Supplementary fee for each class of goods and services beyond three classes
  • 3.3 Complementary fee for the designation of each designated Contracting Party in respect of which an individual fee is not payable(see 3.4, below)
  • Individual fee for the designation of each designated Contracting Party in respect of which an individual fee is payable (see Article 8(7)(a) of the Protocol), except where the designated Contracting Party is a State bound (also) by the Agreement and the Office of origin is the Office of a State bound (also) by the Agreement (in respect of such a Contracting Party, a complementary fee is payable): the amount of the individual fee is fixed by each Contracting Party concerned

Irregularities with respect to the classification of goods and services

The following fees shall be payable (Rule 12(1)(b)):

  • Where the goods and services are not grouped in classes
  • Where the classification, as appearing in the application, of one or more terms is incorrect  provided that, where the total amount due under this item in respect of an international application is less than 150 Swiss francs, no fees shall be payable

Designation subsequent to international registration

The following fees shall be payable and shall cover the period between the effective date of the designation and the expiry of the then current term of the international registration:

  • Basic fee
  • Complementary fee for each designated Contracting Party indicated in the same request where an individual fee is not payable in respect of such designated Contracting Party (see 5.3, below)
  • Individual fee for the designation of each designated Contracting Party in respect of which an individual fee (rather than a complementary fee) is payable (see Article 8(7)(a) of the Protocol) except where the designated Contracting Party is a State bound (also) by the Agreement and the Office of the Contracting Party of the holder is the Office of a State bound (also) by the Agreement (in respect of such a Contracting Party, a complementary fee is payable): the amount of the individual fee is fixed by each Contracting Party concerned

Renewal

The following fees shall be payable and shall cover 10 years:

  • Basic fee
  • Supplementary fee, except if the renewal is made only for designated Contracting Parties in respect of which individual fees are payable (see 6.4, below)
  • Complementary fee for each designated Contracting Party in respect of which an individual fee is not payable (see 6.4, below)
  • Individual fee for the designation of each designated Contracting Party in respect of which an individual fee (rather than a complementary fee) is payable (see Article 8(7)(a) of the Protocol) except where the designated Contracting Party is a State bound (also) by the Agreement and the Office of the Contracting Party of the holder is the Office of a State bound (also) by the Agreement (in respect of such a Contracting Party, a complementary fee is payable): the amount of the individual fee is fixed by each Contracting Party concerned
  • Surcharge for the use of the period of grace

Miscellaneous recordings

  • Total transfer of an international registration
  • Partial transfer (for some of the goods and services or for some of the Contracting Parties) of an international registration
  • Limitation requested by the holder subsequent to international registration, provided that, if the limitation affects more than one Contracting Party, it is the same for all
  • Change in the name and/or address of the holder and/or, where the holder is a legal entity, introduction of or change in the indications concerning the legal nature of the holder and the States and, where applicable, the territorial unit within that State under the law of which the said legal entity has been organized for one or more international registrations for which the same recording or change is requested in the same form
  • Recording of a license in respect of an international registration or amendment of the recording of a license
  • Request for a continued processing under Rule 5bis(1)

Information concerning international registrations

  • Establishing a certified extract from the International Register consisting of an analysis of the situation of an international registration (detailed certified extract), up to three pages, for each page after the third.
  • Establishing a certified extract from the International Register consisting of a copy of all publications, and of all notifications of refusal, made with respect to an international registration (simple certified extract), up to three pages, for each page after the third
  • A single attestation or information in writing, for a single international registration, for each additional international registration if the same information is requested in the same request
  • Reprint or photocopy of the publication of an international registration, per page

Special services

The International Bureau is authorized to collect a fee, whose amount it shall itself fix, for operations to be performed urgently and for services not covered by this Schedule of Fees

  • For international applications filed by applicants whose country of origin is a Least Developed Country, in accordance with the list established by the United Nations, the basic fee is reduced to 10% of the prescribed amount (rounded to the nearest full figure). In such case, the basic fee will amount to 65 Swiss francs (where no reproduction of the mark is in color) or to 90 Swiss francs (where any reproduction of the mark is in color).

Fees refunds in case of Trademark rejection by Authorities

Nowhere in the world, Trademark authorities refund fees, if they reject a trademark registration application. The cost of our Registration Request includes the official fees to submit the application to Trademark Office(s), as well as, the legal fees for reviewing, preparing and following up on your application. These are non-refundable.
